Welcome to MyHairMail®. These Terms of Service, together with any policies, notices, product terms, subscription terms, return/refund policies, privacy notices, and other terms referenced in these Terms, govern your access to and use of the MyHairMail website, online store, content, products, services, account features, subscriptions, communications, and related functionality.
These Terms are a legal agreement between you and MyHairMail LLC (“MyHairMail,” “we,” “us,” or “our”). By accessing or using the Site, creating an account, placing an order, using a subscription, allowing an automated assistant or agent to interact with the Site on your behalf, or otherwise using our services, you agree to these Terms.
Important Notice: Section 21 contains dispute-resolution terms, including arbitration, a class-action waiver, and a jury-trial waiver, unless you opt out as provided below.
If you do not agree to these Terms, do not use the Site or Services.
1. Definitions
“Site” means the MyHairMail website, online store, mobile web experience, and any pages, features, tools, product listings, content, or services we operate or make available.
“Services” means the Site, online store, accounts, subscriptions, product recommendations, order-management features, customer support, communications, promotions, and related services.
“Products” means hair-care, beauty, personal-care, wellness-adjacent, accessories, merchandise, digital items, or other products offered through the Services.
“Content” means text, product descriptions, prices, images, graphics, videos, logos, icons, designs, reviews, software, code, data, product information, styling information, recommendations, and other materials made available through the Services.
“Product Data” means product names, prices, discounts, availability, inventory information, SKUs, product descriptions, product images, ratings, reviews, bundles, recommendations, shipping information, promotional offers, and other commerce-related information displayed on or derived from the Site.
“Agent” means any automated, semi-automated, AI-enabled, software-driven, scripted, robotic, browser-automation, crawler, bot, plugin, shopping assistant, comparison assistant, personal assistant, or other non-human tool that accesses or interacts with the Site.
“Authorized Personal Agent” means an Agent acting at the direction of an individual consumer for that consumer’s personal, household, accessibility, shopping, order-management, or customer-service purpose, and not for resale, scraping, competitive intelligence, model training, data brokerage, or other prohibited use.
2. Eligibility and Accounts
You must be at least the age of majority in your place of residence, or have permission from a parent or legal guardian, to use the Services. The Services are not intended for children under 13.
You agree to provide accurate, current, and complete information when creating an account, placing an order, subscribing, contacting support, or otherwise using the Services. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account, including activity by any person or Agent you authorize.
We may refuse service, close accounts, limit purchases, suspend access, cancel orders, or restrict use of the Services if we believe that activity violates these Terms, creates legal or security risk, harms MyHairMail or others, or is fraudulent, abusive, automated in a prohibited way, or inconsistent with ordinary consumer use.
3. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect personal information. The Privacy Policy is incorporated into these Terms.
If you use a third-party Agent, browser extension, AI assistant, payment wallet, shopping tool, or similar service, that third party may collect, receive, process, or store your information. We are not responsible for the privacy, security, accuracy, or conduct of third-party Agents or services you choose to use.
4. Product Information and Personal-Care Disclaimer
We try to provide accurate product information, including descriptions, images, prices, ingredients, instructions, availability, and other details. However, we do not guarantee that all Product information is complete, current, accurate, or error-free.
Product images may vary from actual Products due to packaging changes, lighting, screen settings, or manufacturer updates. Always read labels, warnings, directions, and ingredient lists before using any Product.
Products sold through the Services are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Hair-care and personal-care Products may cause irritation, allergic reactions, or unexpected results. Use Products only as directed, perform patch tests when appropriate, discontinue use if irritation occurs, and consult a qualified professional or healthcare provider when needed.
5. Orders, Acceptance, Pricing, and Availability
Placing an order does not guarantee acceptance. An order is accepted only when we confirm acceptance or ship the Product, depending on our order-processing workflow.
Prices, promotions, discounts, shipping charges, taxes, availability, and Product details may change without notice. We reserve the right to correct errors, inaccuracies, or omissions at any time, including after an order has been submitted.
We may refuse, cancel, limit, or modify any order for any lawful reason, including suspected fraud, unauthorized resale, inventory limitations, pricing errors, technical errors, payment issues, shipping restrictions, coupon abuse, automated checkout abuse, or violation of these Terms. If we cancel an order after payment has been collected, we will issue a refund for the canceled portion as required by applicable law and our policies.
Pricing Errors. If a Product is listed at an incorrect price, with an incorrect discount, incorrect shipping method, incorrect availability, or other incorrect information due to typographical error, technical issue, supplier issue, system error, or other reason, MyHairMail is not obligated to honor the incorrect information. We may cancel or refuse orders placed for Products listed incorrectly and will notify you and refund amounts paid for canceled items.
Agent-Stale Information. Product Data shown, stored, summarized, or transmitted by a third-party Agent may be outdated or inaccurate. The information displayed by MyHairMail at checkout controls your transaction.
6. Payment, Taxes, and Fraud Review
You agree to pay all amounts shown at checkout, including Product prices, shipping, handling, taxes, fees, and any other charges. You represent that you are authorized to use the payment method provided.
We and our payment service providers may authorize, verify, capture, store tokens for, or process payments. We may use fraud-prevention tools and may request additional information before accepting or shipping an order.
You are responsible for any taxes, duties, customs charges, import fees, or similar amounts that apply to your purchase, unless we expressly state otherwise at checkout.
7. Subscriptions, Auto-Renewals, and Recurring Orders
This section applies only if you purchase a subscription, auto-renewing plan, recurring shipment, membership, replenishment program, or other negative-option offer.
Before you enroll, we will disclose the material terms of the subscription, including the Products or benefits included, billing amount, billing frequency, renewal terms, cancellation method, and any trial or promotional terms that apply. By enrolling, you authorize us or our payment processor to charge your payment method on a recurring basis until you cancel or the subscription ends.
You may cancel your subscription through the cancellation method provided in your account, at checkout, in the subscription terms, or through customer support. To avoid a future charge or shipment, you must cancel before the cutoff time disclosed for your plan. If a recurring order has already been processed, packed, shipped, or otherwise entered fulfillment, cancellation may apply to future renewals only, unless our Return Policy or applicable law provides otherwise.
We may change subscription prices, Products, benefits, shipping charges, or terms by providing notice as required by applicable law. If required, changes will apply only after notice and any required consent.
8. Shipping, Delivery, Risk, and Delays
Shipping options, costs, and estimated delivery times are shown at checkout or in our shipping policy. Delivery dates are estimates unless we expressly state otherwise.
We will use commercially reasonable efforts to ship orders within the timeframe we state. If no timeframe is stated, we will process and ship according to our standard fulfillment practices and applicable law.
Shipping delays may occur due to inventory, carriers, weather, holidays, address issues, customs, payment review, fraud review, force majeure events, or other circumstances. If we cannot ship within the promised timeframe, we may notify you, seek your consent to a delay, cancel the order, or provide a refund as required by applicable law and our policies.
Risk of loss and title pass as stated at checkout, in the applicable shipping terms, or as provided by applicable law.
9. Returns, Refunds, Exchanges, and Cancellations
Returns, refunds, exchanges, damaged-item claims, missing-package claims, and order cancellations are governed by our Return Policy and any terms stated at checkout or included with the Product.
Because hair-care, beauty, and personal-care items may raise hygiene, safety, or product-integrity concerns, some Products may be final sale, non-returnable, or returnable only if unopened, unused, defective, damaged, or otherwise eligible under our policy or applicable law.
Refunds will be issued to the original payment method unless we state otherwise or applicable law requires a different approach. Shipping fees, return shipping, handling charges, promotional discounts, and gift-card amounts may be handled as stated in our Return Policy.
10. Promotions, Coupons, Rewards, and Gift Cards
Promotions, coupon codes, discounts, rewards, referral credits, bundles, samples, gifts with purchase, and gift cards are subject to the terms presented with the offer. They may be limited by date, Product, quantity, customer, geography, account, or other conditions.
Promotions have no cash value unless required by law. We may modify, suspend, revoke, or cancel promotions for fraud, abuse, mistake, technical error, unauthorized resale, automated use, or violation of these Terms.
You may not use bots, scripts, fake accounts, account farms, coupon-stacking abuse, referral manipulation, automated checkout tools, or other methods to exploit promotions.
11. Permitted Use of the Services
You may use the Services for lawful, personal, non-commercial shopping, account management, order tracking, returns, customer support, and related purposes.
You agree not to:
1. Violate any applicable law, regulation, or third-party right.
2. Use the Services for fraud, deception, resale abuse, chargeback abuse, or payment misuse.
3. Interfere with the operation, security, integrity, or availability of the Services.
4. Attempt to gain unauthorized access to accounts, systems, data, or networks.
5. Upload or transmit malware, malicious code, spam, or harmful content.
6. Circumvent access controls, rate limits, checkout limits, bot protections, CAPTCHAs, authentication, geographic restrictions, or security measures.
7. Use the Services to harass, abuse, threaten, impersonate, mislead, or harm others.
8. Copy, frame, mirror, reproduce, sell, resell, or commercially exploit the Services or Content except as expressly permitted.
9. Use the Services in a way that imposes an unreasonable or disproportionate load on our infrastructure.
10. Use the Services for competitive scraping, price monitoring, market intelligence, benchmarking, or data extraction without our prior written permission.
12. Agentic Visitors, AI Assistants, Bots, Crawlers, and Automated Access
We support reasonable consumer use of Agents when they help individual customers shop, compare Products, understand options, manage orders, improve accessibility, or interact with MyHairMail in a way that is comparable to ordinary human browsing.
We do not permit scraping, harvesting, copying, training, benchmarking, market surveillance, resale, or competitive extraction of our Content or Product Data.
12.1 Authorized Personal Agents Are Permitted
You may use an Authorized Personal Agent to:
1. Browse public Product pages for your personal shopping purposes.
2. Compare Products for your own personal or household use.
3. Help you search, filter, or summarize Product information.
4. Add Products to your cart at your direction.
5. Assist with checkout, provided you authorize the purchase and provide accurate payment and shipping information.
6. Retrieve your order status, subscription details, or return information after you authenticate.
7. Help you communicate with customer support.
8. Provide accessibility assistance, screen reading, translation, or personal organization.
You are responsible for the actions of any Agent you authorize. Purchases, subscription changes, cancellations, returns, support requests, account changes, or other actions submitted through your account, credentials, device, payment method, or Agent may be treated as authorized by you, subject to our fraud, security, and order-review rights.
12.2 Conditions for Agent Access
Any Agent accessing the Site must:
1. Act only within the scope of the user’s authorization.
2. Comply with these Terms, our Privacy Policy, our posted technical rules, our robots.txt, any content-signal or crawler instructions we publish, and any rate limits or access restrictions we communicate.
3. Use accurate, non-misleading identifiers where technically feasible, including user-agent strings, headers, or other signals that identify automated access.
4. Avoid spoofing, cloaking, rotating identities to evade controls, or disguising the source or purpose of traffic.
5. Access only the pages, account areas, and data the user is authorized to access.
6. Avoid collecting more Content or Product Data than is reasonably necessary for the user’s specific personal shopping or account-management task.
7. Avoid retaining MyHairMail Content or Product Data longer than reasonably necessary for the user’s specific request, unless we expressly permit retention.
8. Respect checkout limits, purchase limits, coupon limits, subscription rules, and inventory protections.
9. Stop or reduce traffic promptly if requested by MyHairMail or if the Agent receives technical signals indicating blocking, throttling, or rate limits.
12.3 Prohibited Automated Access
Without MyHairMail’s prior written permission, you may not use any Agent, bot, crawler, scraper, script, plugin, extension, automation platform, AI system, or similar tool to:
1. Scrape, harvest, extract, copy, download, monitor, or store Content or Product Data at scale.
2. Build or maintain a product database, price database, image database, review database, market-intelligence tool, competitive-monitoring tool, or similar dataset.
3. Train, fine-tune, test, benchmark, improve, or evaluate any AI model, machine-learning model, ranking system, recommendation engine, or automated decision system using MyHairMail Content or Product Data.
4. Create persistent embeddings, vector databases, knowledge graphs, summaries, model weights, or derivative datasets from MyHairMail Content or Product Data, except transient processing that is strictly necessary for an Authorized Personal Agent to fulfill a single user-requested shopping task.
5. Use Product Data for competitor price monitoring, assortment monitoring, inventory monitoring, promotion tracking, SEO research, ad targeting, supplier analysis, or competitive intelligence.
6. Copy or republish Product listings, Product images, reviews, descriptions, or other Content.
7. Create substitute products, services, websites, apps, marketplaces, catalogs, comparison tools, or AI-shopping experiences that compete with or divert value from MyHairMail using our Content or Product Data.
8. Execute bulk purchases, inventory hoarding, cart stuffing, denial-of-inventory activity, scalping, resale arbitrage, coupon abuse, or automated checkout abuse.
9. Create accounts, submit forms, post reviews, generate referrals, apply coupons, or trigger communications in an automated or deceptive way.
10. Probe, scan, test, or attack the vulnerability of the Site without written authorization.
11. Circumvent, bypass, disable, or interfere with bot-management systems, CAPTCHAs, rate limits, authentication, access controls, or security measures.
12. Continue accessing the Site after being blocked, rate-limited, denied, or instructed to stop.
12.4 Competitors and Commercial Agents
Competitors may visit the public Site as ordinary consumers, but they may not use Agents or automated methods to extract, monitor, copy, benchmark, or analyze Content or Product Data for competitive purposes without our prior written permission.
Commercial Agent operators, AI-shopping platforms, search engines, comparison engines, browser-extension operators, data brokers, analytics providers, resellers, marketplace aggregators, and other commercial entities must obtain written permission before using automated access beyond ordinary public search indexing or Authorized Personal Agent activity.
12.5 Search Indexing and AI Use
We may allow ordinary public search indexing when conducted in compliance with our robots.txt, content signals, technical instructions, and these Terms.
Unless expressly allowed in writing or by a specific machine-readable permission we publish, we do not grant permission to use MyHairMail Content or Product Data for AI training, model fine-tuning, persistent retrieval systems, AI-generated search summaries, commercial answer engines, embeddings, dataset creation, or similar uses.
A user-directed Agent may temporarily process Product information to respond to that individual user’s specific shopping request, but that permission does not allow the Agent operator to retain, reuse, sell, train on, aggregate, or commercialize MyHairMail Content or Product Data.
12.6 Enforcement
We may monitor traffic, log automated activity, require authentication, challenge requests, rate-limit, block, throttle, suspend, or revoke access by any user, Agent, IP address, account, network, or tool that we believe violates these Terms or threatens the security, availability, integrity, or commercial value of the Services.
Violation of this Section may cause irreparable harm to MyHairMail. We may seek injunctive relief, damages, attorneys’ fees, technical remedies, and any other remedies available under contract, intellectual property, unfair competition, computer access, anti-circumvention, trespass, or other applicable laws.
13. Intellectual Property
MyHairMail®, the MyHairMail logo, and all related names, logos, product names, graphics, trade dress, designs, slogans, and marks are trademarks, service marks, trade names, or intellectual property of MyHairMail LLC or its licensors. All other marks are the property of their respective owners.
The Services and Content are owned by MyHairMail, our licensors, suppliers, partners, or other rights holders and are protected by copyright, trademark, trade dress, trade secret, database, unfair competition, and other laws.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your lawful personal shopping and account-management purposes. No other rights are granted.
You may not copy, reproduce, distribute, publicly display, publicly perform, modify, adapt, translate, create derivative works from, sell, license, scrape, mine, extract, or exploit the Services, Content, or Product Data except as expressly allowed by these Terms or by our written permission.
All rights not expressly granted are reserved.
14. User Content, Reviews, and Submissions
You may be able to submit reviews, photos, comments, feedback, questions, social media tags, testimonials, or other content (“User Content”).
You retain ownership of your User Content, but you grant MyHairMail a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, display, perform, create derivative works from, and otherwise use your User Content in connection with the Services, marketing, advertising, social media, customer support, product improvement, and related business purposes.
You represent and warrant that:
1. You own or have the rights necessary to submit your User Content.
2. Your User Content is accurate and not misleading.
3. Your User Content does not violate any law or third-party right.
4. Your User Content does not contain malware, spam, harassment, hate, threats, or unlawful material.
5. If you received free products, compensation, discounts, rewards, or any other benefit in exchange for posting or reviewing, you will clearly disclose that connection.
We may moderate, remove, reject, or edit User Content for any lawful reason, including if we believe it is false, misleading, unlawful, infringing, abusive, obscene, spam, promotional, irrelevant, generated by bots, submitted through fake accounts, or otherwise inconsistent with these Terms. We do not promise to display any User Content.
15. Feedback
If you submit suggestions, ideas, improvements, feature requests, product concepts, marketing ideas, or other feedback, you grant us the right to use that feedback without restriction or compensation. Do not submit feedback you consider confidential or proprietary.
16. Copyright Complaints
If you believe Content on the Services infringes your copyright, you may send a written notice to our designated copyright contact at:

1. Your name, address, telephone number, and email address.

3. Identification of the allegedly infringing material and where it appears.
4. A statement that you have a good-faith belief that the use is not authorized.
5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
6. Your physical or electronic signature.
We may remove or disable access to allegedly infringing material and may terminate repeat infringers when appropriate.
17. Third-Party Services and Links
The Services may include links, integrations, payment processors, shipping carriers, social media platforms, analytics tools, AI tools, plugins, or other third-party services. We do not control and are not responsible for third-party services, content, terms, privacy practices, security, availability, errors, or conduct.
Your use of third-party services is governed by their terms and policies.
18. Electronic Communications, Email, and Text Messages
You consent to receive electronic communications from us, including emails, account notices, order confirmations, shipping updates, subscription notices, legal notices, and support messages.
If you opt in to marketing emails or text messages, you consent to receive promotional communications from MyHairMail. Marketing consent is not required to make a purchase. You may opt out of marketing emails by using the unsubscribe link and may opt out of marketing text messages by following the instructions provided in the message. Transactional or account-related messages may continue as permitted by law.

19. Security
We use reasonable administrative, technical, and physical safeguards designed to protect the Services and information we process. However, no website, network, transmission, storage system, or security measure is completely secure.
You agree to use reasonable security practices, including protecting your login credentials, using accurate contact information, promptly notifying us of unauthorized account activity, and not sharing your account with unauthorized persons or Agents.
20. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES, CONTENT, PRODUCT DATA, AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” EXCEPT AS EXPRESSLY STATED BY MYHAIRMAIL IN WRITING OR REQUIRED BY APPLICABLE LAW.
MYHAIRMAIL DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, QUIET ENJOYMENT, AND COURSE OF DEALING.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, VIRUS-FREE, COMPATIBLE WITH ANY AGENT OR DEVICE, OR THAT DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THAT PRODUCT INFORMATION, PRICES, AVAILABILITY, RECOMMENDATIONS, REVIEWS, OR THIRD-PARTY AGENT SUMMARIES WILL BE ACCURATE, COMPLETE, OR CURRENT.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME DISCLAIMERS MAY NOT APPLY TO YOU.
21. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYHAIRMAIL AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS, LICENSORS, SERVICE PROVIDERS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, REPUTATIONAL HARM, COST OF SUBSTITUTE GOODS OR SERVICES, OR DAMAGES ARISING FROM UNAUTHORIZED ACCESS, AUTOMATED ACCESS, AGENT ERROR, SERVICE INTERRUPTION, PRODUCT MISUSE, OR THIRD-PARTY SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES, PRODUCTS, OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
1. THE AMOUNT YOU PAID TO MYHAIRMAIL FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY; OR
2. $100.
THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, STATUTE, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.
NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
22. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless MyHairMail and its owners, officers, directors, employees, contractors, agents, suppliers, licensors, service providers, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
1. Your use or misuse of the Services or Products.
2. Your violation of these Terms.
3. Your violation of law or third-party rights.
4. Your User Content.
5. Your fraud, negligence, willful misconduct, or misrepresentation.
6. Any activity by your account, credentials, payment method, device, network, or Agent.
7. Any prohibited automated access, scraping, data extraction, AI training, competitive monitoring, or misuse of Product Data.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.
23. Dispute Resolution, Arbitration, Class Waiver, and Jury Waiver
Please read this section carefully. It affects your legal rights.
23.1 Informal Resolution
Before filing a claim, you agree to contact us at [legal@myhairmail.com] and provide your name, contact information, account email if applicable, a description of the dispute, and the relief you seek. We will attempt to resolve the dispute informally.
23.2 Binding Arbitration
Except for the exceptions below, any dispute, claim, or controversy arising out of or relating to these Terms, the Services, Products, orders, subscriptions, Content, Product Data, or your relationship with MyHairMail will be resolved by binding arbitration rather than in court.
The arbitration will be administered by [AAA/JAMS/other provider] under its applicable consumer arbitration rules. The arbitration will take place in [County, New York], unless the arbitrator allows remote proceedings or another location is required by applicable law.
23.3 Exceptions
Either party may bring claims in small claims court if eligible. MyHairMail may seek injunctive or equitable relief in court for intellectual-property misuse, security threats, unauthorized access, scraping, bot abuse, AI training misuse, data extraction, or other conduct that may cause irreparable harm.
23.4 Class Action Waiver
You and MyHairMail agree that disputes will be resolved only on an individual basis. You may not bring, join, or participate in a class action, collective action, private attorney general action, consolidated action, or representative action, unless this waiver is found unenforceable by a court or arbitrator and applicable law requires otherwise.
23.5 Jury Trial Waiver
To the maximum extent permitted by law, you and MyHairMail waive any right to a jury trial for any dispute not subject to arbitration.
23.6 Opt-Out
You may opt out of arbitration by sending written notice to [legal@myhairmail.com] within 30 days after you first agree to these Terms. Your notice must include your name, email address, mailing address, and a statement that you opt out of arbitration. Opting out of arbitration does not opt you out of any other part of these Terms.
24. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules, except to the extent federal law applies or applicable consumer law requires otherwise.
For disputes not subject to arbitration, you and MyHairMail consent to the exclusive jurisdiction and venue of the state and federal courts located in [County, New York], except for small claims matters or where applicable law requires another forum.
25. Changes to the Services and Terms
We may modify, suspend, discontinue, or replace any part of the Services at any time.
We may update these Terms from time to time. The updated Terms will be effective when posted, unless we state a later effective date or applicable law requires additional notice. Your continued use of the Services after updated Terms become effective means you accept the updated Terms.
For subscriptions or recurring services, material changes will apply as disclosed in the notice and as permitted by applicable law.
26. Termination and Suspension
You may stop using the Services at any time. We may suspend, terminate, restrict, or refuse your access to the Services, accounts, subscriptions, promotions, or automated access at any time if we believe you violated these Terms, created risk, engaged in fraud or abuse, or used the Services in a way that harms MyHairMail or others.
Upon termination, your right to use the Services ends immediately. Sections that by their nature should survive will survive, including sections relating to intellectual property, automated access, Product Data, User Content licenses, disclaimers, limitations of liability, indemnification, dispute resolution, and general terms.
27. International Use, Sanctions, and Export Compliance
The Services are operated from the United States. We do not represent that the Services or Products are appropriate, lawful, or available in all locations. You are responsible for complying with laws that apply to you.
You may not use the Services or purchase Products if you are prohibited from doing so under applicable sanctions, export-control, or trade-restriction laws.
28. Force Majeure
We will not be liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, labor issues, supply-chain disruptions, carrier delays, internet or utility failures, cyberattacks, war, terrorism, civil unrest, government action, pandemics, or other events beyond our reasonable control.
29. Assignment
You may not assign or transfer these Terms or your rights or obligations under them without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, corporate transaction, or by operation of law.
30. Severability, No Waiver, and Entire Agreement
If any provision of these Terms is found unenforceable, that provision will be modified or severed to the minimum extent necessary, and the remaining provisions will remain in effect.
Our failure to enforce any provision is not a waiver of our right to enforce it later.
These Terms, together with the Privacy Policy and any other policies or terms incorporated by reference, form the entire agreement between you and MyHairMail regarding the Services.
